Effi Home Pty Ltd (ABN 68 683 898 580) ('we', 'us', 'our') operates effihome.com.au and any related mobile applications (collectively, the 'Site').

This Privacy Policy describes how your personal information is collected, used, stored and shared when you visit or make a purchase from the Site. It also explains your rights in relation to that information.

We collect, use, store and share your personal information in accordance with the Privacy Act 1988 (Cth) (including the Australian Privacy Principles) and the Spam Act 2003 (Cth).

2. PERSONAL INFORMATION WE COLLECT AND HOLD

Device Information

When you visit the Site, we automatically collect certain information about your device, including your web browser, IP address, time zone, and cookies installed on your device. As you browse, we collect information about the pages or products you view, search terms that referred you to the Site, and how you interact with the Site ('Device Information').

We collect Device Information using:

  • Cookies — small data files placed on your device that often include an anonymous unique identifier.
  • Log files — tracking actions on the Site, including IP address, browser type, ISP, referring/exit pages, and timestamps.
  • Web beacons, tags and pixels — electronic files used to record how you browse the Site.

Order and Customer Information

When you make or attempt to make a purchase through the Site, we collect your name, billing and shipping address, email address, phone number, and payment information (including credit card details). We also retain your order history ('Order Information').

Marketing Information

If you opt in to receive marketing communications, we will collect and hold your name, email address and/or phone number for that purpose. Providing this information for marketing is entirely voluntary and is not a condition of purchase.

When we refer to 'Personal Information' in this Privacy Policy, we mean Device Information, Order Information, and Marketing Information collectively — any information that relates to, describes, or could reasonably be associated with you.

3. HOW WE USE YOUR PERSONAL INFORMATION

We use the information we collect to:

  • Fulfil orders, including processing payments, arranging shipping, and providing invoices and order confirmations.
  • Communicate with you about your order, including transactional emails and SMS notifications.
  • Screen orders for potential risk or fraud.
  • Improve and optimise the Site, including generating analytics about how customers browse and interact with it.
  • Provide targeted advertising and assess the success of our marketing campaigns.
  • Send you marketing communications (email and/or SMS) where you have given express consent.
  • Comply with our legal obligations.

4. DIRECT MARKETING

We will only use your Personal Information for direct marketing if you have given express consent, in accordance with the Privacy Act 1988 (Cth) (APP 7) and the Spam Act 2003 (Cth). Consent to receive marketing is never a condition of purchase.

Email Marketing

With your express consent, we may send you commercial electronic messages about our products, services, promotions, and store updates. Every marketing email will clearly identify us as the sender and include a functional unsubscribe mechanism, in compliance with the Spam Act 2003 (Cth).

You may opt out of email marketing at any time by:

  • Clicking the 'Unsubscribe' link included in every marketing email; or
  • Contacting us at hello@effihome.com.au.

We will process your opt-out promptly. Unsubscribing from marketing emails will not affect transactional messages related to active orders.

SMS / Text Message Marketing

With your prior express written consent, we may send you SMS or MMS messages about our products, services, promotions, and store updates. We will only send SMS marketing after you have affirmatively opted in — for example, by checking a consent box at checkout or completing a sign-up form.

Key terms of our SMS marketing program:

  • Message frequency: Message frequency varies. We generally send no more than 4 messages per month, though frequency may vary based on promotions and your interactions with us.
  • Costs: Message and data rates may apply depending on your mobile carrier and plan. We are not responsible for any charges from your carrier.
  • Opt-out: Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any SMS from us to opt out. You will receive one final confirmation and no further SMS marketing.
  • Help: Text HELP to any SMS from us, or email hello@effihome.com.au, for support.
  • Compatibility: If your device does not support MMS, we will send a standard SMS (text-only) message instead.

Opting out of SMS marketing will not affect transactional order messages, which are sent separately.

Consent to receive SMS marketing is separate from consent to receive email marketing. You may opt into one, both, or neither.

Third-Party Marketing Platforms

We may use third-party platforms (such as Klaviyo) to send marketing emails and SMS messages on our behalf. These providers act as data processors under our instruction and are contractually required to protect your information. They are not permitted to use your contact details for their own marketing purposes. We do not sell, rent, loan, trade, or otherwise transfer your phone number or email address to any third party for their own direct marketing.

5. CONSENT

How We Obtain Your Consent

When you provide personal information to complete a transaction, verify your credit card, place an order, arrange a delivery, or process a return, we collect that information specifically to fulfil that purpose.

For marketing communications, we will ask for your separate, express consent — for example, via a clearly labelled opt-in checkbox at checkout or a sign-up form. We will not send marketing communications based on implied consent alone.

How to Withdraw Your Consent

You may withdraw your consent to receive marketing communications at any time:

  • Email: Click 'Unsubscribe' in any marketing email, or contact hello@effihome.com.au.
  • SMS: Reply STOP to any SMS, or contact hello@effihome.com.au.

Withdrawing consent does not affect the lawfulness of any communication sent before your withdrawal, nor does it affect processing carried out on other legal grounds (e.g. fulfilment of your order).

6. SHARING YOUR PERSONAL INFORMATION

We share your Personal Information with third parties only to the extent necessary to run our business and provide our services. We do not sell your Personal Information.

We may share your information with:

  • Shopify Inc. — our e-commerce platform provider. See Shopify's Privacy Statement at https://www.shopify.com/legal/privacy.
  • Payment processors and gateways — to process your transactions securely.
  • Logistics and fulfilment providers — to arrange shipping and delivery of your order.
  • Marketing platforms (e.g. Klaviyo) — to send authorised email and SMS marketing communications.
  • Google Analytics and advertising partners — to analyse Site usage and deliver targeted advertising.
  • Legal and regulatory authorities — where required by law, regulation, court order, or to protect our legal rights.

We may also share your information in connection with a merger, acquisition, or sale of all or part of our business, in which case the acquiring entity will be bound to handle your information in accordance with this Privacy Policy.

7. INTERNATIONAL DATA TRANSFERS

Some of our third-party service providers (including Shopify, Klaviyo, and Google) are located outside Australia. Sharing your Personal Information with them may involve transferring your data overseas, including to the United States, New Zealand, and the European Union.

Before disclosing your Personal Information to an overseas recipient, we take reasonable steps to ensure the recipient handles your information consistently with the Australian Privacy Principles, in compliance with APP 8 of the Privacy Act 1988 (Cth).

By using our Site or providing us with your Personal Information, you acknowledge that your information may be transferred to and stored in countries outside Australia.

8. SHOPIFY

Our store is hosted on Shopify Inc., which provides us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify's data storage, databases, and general application on a secure server.

Payment

If you choose a direct payment gateway, Shopify stores your credit card data encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Transaction data is stored only as long as necessary to complete the transaction and is then deleted. All payment gateways adhere to PCI-DSS standards managed by the PCI Security Standards Council.

9. BEHAVIOURAL ADVERTISING

We use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. We use Google Analytics and third-party audience data (such as age, gender, and interests) to better understand our customers and deliver relevant advertising.

Please note that we do not alter our Site's data collection and use practices when we receive a Do Not Track signal from your browser.

10. SECURITY

We take reasonable precautions and follow industry best practices to protect your Personal Information from loss, misuse, unauthorised access, disclosure, alteration, or destruction, in compliance with APP 11 of the Privacy Act 1988 (Cth).

Credit card information is encrypted using Secure Socket Layer technology (SSL) and stored with AES-256 encryption. Although no method of transmission over the internet is 100% secure, we implement generally accepted industry standards and all applicable PCI-DSS requirements.

In the event of a data breach likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) in accordance with the Notifiable Data Breaches scheme under the Privacy Act 1988 (Cth).

11. COOKIES

Cookies are small data files placed on your device when you visit the Site. We use cookies to power essential Site functionality, remember your preferences, and understand how you use the Site. You may disable cookies through your browser settings, though this may affect certain Site features.

The following cookies are used on our Site:

  • _session_id — Unique token, sessional. Allows Shopify to store session information (referrer, landing page, etc.).
  • _shopify_visit — No data held, persistent for 30 minutes from the last visit. Used by Shopify's internal stats tracker.
  • _shopify_uniq — No data held, expires at midnight of the next day. Counts visits by a single customer.
  • cart — Unique token, persistent for 2 weeks. Stores the contents of your cart.
  • _secure_session_id — Unique token, sessional.
  • storefront_digest — Unique token, indefinite. Used if the shop has a password to determine visitor access.

12. YOUR RIGHTS

Under the Privacy Act 1988 (Cth) and the Australian Privacy Principles, you have the following rights in relation to your Personal Information:

  • Access: You may request access to the Personal Information we hold about you.
  • Correction: You may request that we correct any Personal Information that is inaccurate, out of date, incomplete, irrelevant, or misleading.
  • Opt-out of direct marketing: You may opt out of receiving direct marketing communications from us at any time (see Section 5).
  • Complaint: You may make a complaint about a breach of the Australian Privacy Principles by contacting us. If we do not resolve your complaint to your satisfaction, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or by calling 1300 363 992.

To exercise any of these rights, please contact us using the details in Section 16. We will respond within a reasonable timeframe. If we refuse a request, we will provide written reasons.

We will not discriminate against you for exercising any of these privacy rights.

13. DATA RETENTION

We retain your Personal Information for as long as necessary to fulfil the purposes for which it was collected, including to:

  • Complete any transaction or order;
  • Maintain records required for legal, accounting, or regulatory obligations;
  • Resolve disputes and enforce our agreements; or
  • Continue sending marketing communications for which you have given consent (until you withdraw that consent).

When Personal Information is no longer required, we will take reasonable steps to delete or de-identify it.

14. AGE RESTRICTIONS

The Site is intended for individuals who are at least 18 years of age, or the age of majority in their jurisdiction. By using the Site, you represent that you meet this requirement. We do not knowingly collect Personal Information from individuals under 18 years of age for marketing purposes.

The SMS marketing program is available to individuals aged 18 years and over. 

If you are a parent or guardian and believe we have collected information from a minor without appropriate consent, please contact us at hello@effihome.com.au and we will delete that information promptly.

15. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time to reflect changes to our practices or for legal or regulatory reasons. Changes will take effect immediately upon being posted to the Site. We will update the 'Last updated' date at the top of this Policy when changes are made.

If we make material changes to how we handle your Personal Information, we will notify you by email or by a prominent notice on the Site before the changes take effect.
